Would it be copyright?
if I named a clothing line ABERZOMBIE? with a Z
I’m trying to start silk screening shirts and I want to be able to put the logo on the bottom side…would it be copyright?
The relevant legal issues have to do not with copyright – a name cannot, by law, be copyrighted – but with trademark.
If your “Aberzombie” clothing could, by a reasonable person, be confused with “Abercrombie” clothing, then it is a breach of Abercrombie’s trademark rights, and they could sue you.
The decision as to whether a use is a violation depends on many subjective factors, including whether the court believes that there is an intent to confuse potential customers.
